The mother was arrested for

  • Driving while intoxicated (DWI)
  • Resisting arrest
  • Endangering the welfare of a child

The Leandra’s Law charge and the endangering the welfare of a child charges stem from the fact that the mother had her 6-year old child with her in the car at the time of the accident. Leandra’s Law is a felony charge and could cause her to serve substantial jail time.

Apart from legal charges, having the child in the car while driving drunk could result in the removal of her child. Officers at the scene turned the child over to relatives.
