Under the criminal procedure law, an arraignment is typically going to be the first time that an individual charged with a crime is brought before a judge in the court. It can be after receiving an appearance ticket, telling you to come to court on a certain day for your arraignment. Or it can be that you were arrested by members of law enforcement and brought that same day or the very next day to see a judge and to be arraigned. At the arraignment, you’re typically going to enter a plea of not guilty and both sides are going to have an opportunity to be heard about whether or not there should be bail.

The prosecution will typically go first and determine whether or not they’re asking for bail and whether or not under the new Bail Reform Act in New York State, the crime that the individual is charged with is even eligible for bail. If it is and they’re asking for bail, then the attorney for the defendant is typically able to explain all the reasons why the bail being sought by the prosecution is unreasonable and why the judge should set very different bail or no bail at all.
